1. What Dion is
Dion is an AI-powered creative director you interact with via SMS, operated by The Brooklyn App Company ("we," "us," "our"). Text Dion to check your fit, redesign a room, build a moodboard, get outfit feedback, or explore your creativity.
Dion is AI-assisted. The creative sensibility and personality are human-directed, but the responses, image generation, and analysis are powered by artificial intelligence. Think of it as a creative collaborator that happens to be available 24/7 via text.
2. Acceptance of terms
By texting Dion or using our website at heydion.com, you agree to these Terms of Service. If you do not agree, please do not use the service.
3. The service
Dion provides AI-powered creative assistance via SMS. The service is currently offered free of charge. We reserve the right to modify, suspend, or discontinue the service (or any part of it) at any time, with or without notice.
We may introduce paid tiers, change pricing, or alter the feature set in the future. If we make changes that materially affect your use, we'll notify you via the phone number you registered with.
4. Your account
To use Dion, you text a phone number and interact via SMS. There are no passwords, logins, or traditional accounts. Your phone number is your identity on the service. You're responsible for maintaining access to the phone number you use with Dion.
You may share images, describe creative projects, or provide preferences during conversations. These are used to personalize your experience and provide relevant creative responses.
5. Acceptable use
You agree not to:
- Use the service for any unlawful purpose
- Attempt to interfere with or disrupt the service
- Use a phone number that is not yours
- Use automated systems to send messages in bulk
- Send content that is illegal, harmful, or violates the rights of others
- Redistribute or resell Dion's generated content commercially without permission
6. Content and intellectual property
Dion generates creative content using AI. While we strive to provide helpful and inspiring responses, we do not guarantee that all suggestions, designs, or analyses are accurate, appropriate, or complete. Dion's responses are for creative inspiration and should not be relied upon as professional design, fashion, or interior design advice.
Images you send to Dion remain yours. AI-generated images and content created by Dion during your conversations are provided for your personal use. The Dion name, branding, and platform are owned by The Brooklyn App Company.
7. SMS communication
Dion is an SMS-first product. By texting Dion, you consent to receive SMS messages in response to your texts. Standard message and data rates from your carrier may apply.
To stop receiving messages, text "STOP" at any time. This is immediate and results in opting out of the service. You can rejoin at any time by texting Dion again.
8. Disclaimer of warranties
Dion is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. We make no guarantees about the accuracy, reliability, or completeness of any content generated by the service.
9. Limitation of liability
To the maximum extent permitted by law, The Brooklyn App Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the service, including but not limited to damages for loss of profits, data, or goodwill.
10. Termination
You may stop using Dion at any time by texting "STOP." We may also suspend or terminate your access to the service at our discretion, including if we reasonably believe you have violated these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.
11. Indemnification
You agree to indemnify and hold harmless The Brooklyn App Company, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your violation of these terms or your misuse of the service.
12. Changes to these terms
We may update these Terms of Service from time to time. When we do, we'll update the "Last updated" date at the top of this page. For significant changes, we'll notify you via SMS. Your continued use of the service after changes take effect constitutes acceptance of the updated terms.
13. Governing law
These terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these terms or the service shall be resolved in the courts located in Kings County, New York.
14. Severability
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
15. Entire agreement
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and The Brooklyn App Company regarding your use of Dion. They supersede any prior agreements or understandings, whether written or oral.
